Resumo

O Estado Democrático de Direito é a qualidade do Estado Constitucional e internacional de Direito que tem como finalidade proporcionar meios e assegurar a mais ampla proteção dos direitos fundamentais. Encontra na dignidade humana seu elemento nuclear e na soberania popular, na democracia e na justiça social os seus fundamentos. O livre processo politico é a forma de realização do direito, sob a ordem jurídica, que exige, tanto dos poderes do estado quanto da sociedade, formas de expressão de suas preferências que darão subsídios as ações governamentais. As lacunas da Lei é uma forma de emancipação do Estado Democrático de Direito e realização do direito. Resta saber se as decisões que envolvem os princípios (com sistemas abertos para definições axiológicas ou teleológicas) fazem parte desse “gap”, e se os argumentos utilizados nas decisões reforçam a emancipação e realização do Direito.

The Democratic Rule of Law is the quality of the Constitutional and international rule of law that aims to provide means and ensure the broadest protection of fundamental rights. It finds its core element in human dignity and its foundations in popular sovereignty, democracy and social justice. The free political process is the form of realization of the law, under the legal order, which requires, both from the powers of the state and society, forms of expression of their preferences that will give subsidies to governmental actions. The gaps in the Law is a form of emancipation from the Democratic Rule of Law and realization of the law. It remains to be seen whether decisions involving principles (with open systems for axiological or teleological definitions) are part of this “gap”, and whether the arguments used in the decisions reinforce the emancipation and realization of Law.
